Fleet Phospho-Soda Lawsuit

FDA Safety Alert and Recall for Phospho-Soda

In December, 2008, the FDA issued an “Alert” for Fleet Phospho-Soda laxatives warning that the use of Fleet Phospho-Soda for bowel cleansing prior to colonoscopy or other surgery could lead to kidney damage and failure. The Alert stated: "[I]n light of the risk of acute phosphate nephropathy, over-the-counter laxative OSP [oral sodium phosphate] products should not be used for bowel cleansing."

According to the FDA Alert: “Acute phosphate nephropathy is a form of acute kidney injury that is associated with deposits of calcium-phosphate crystals in the renal tubules that may result in permanent renal function impairment. Acute phosphate nephropathy is a rare, serious adverse event that has been associated with the use of OSPs.” (oral sodium phosphates)

Following the Alert, CB Fleet recalled Fleet Phospho-soda.

Are you suffering from kidney damage?

There have been numerous lawsuits in over twenty states brought on behalf of individuals against CB Fleet for Fleet Phospho-Soda injuries and serious kidney damage. These product liability/personal injury lawsuits allege that CB Fleet improperly marketed Fleet Phospho-Soda at higher dosages than allowed by the FDA for over-the-counter oral laxatives containing sodium phosphate. The safety of the product at these higher doses has not been proved, and may lead to deposits of calcium and phosphate in the kidneys, requiring dialysis or kidney transplant.
